Exclusive Content License & Submission Policy

PPA Tour Canada

Welcome to the PPA Tour Canada platform, including our websites, social media channels, and applications (collectively, the “Platform”). This Exclusive Content License & Submission Policy (this “Agreement”) explains the terms that apply to any content you submit, upload, post, or otherwise provide to us through the Platform, including but not limited to photos, videos, audio, text, graphics, and other materials (collectively, “Your Content”).

By submitting Your Content, you agree to this Agreement.

1. Exclusive License Grant

By submitting Your Content to the Platform, you grant PPA Tour Canada, its affiliates, partners, licensees, successors, and assigns an exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable, and transferable license to use, reproduce, copy, modify, adapt, publish, translate, distribute, display, perform, create derivative works from, and otherwise exploit Your Content in any media or format now known or later developed, for any lawful purpose.

This includes, without limitation, the right to use Your Content for:

  • publication on the Platform;
  • marketing, advertising, and promotional campaigns;
  • social media, email, and digital communications;
  • sponsorships and brand partnerships;
  • licensing to third parties;
  • editorial and commercial uses;
  • merchandise and product-related uses; and
  • protection and enforcement of rights related to Your Content, including pursuing infringement claims.

Because this license is exclusive, you agree that you will not license, distribute, publish, or otherwise commercially exploit Your Content in a manner that conflicts with the rights granted under this Agreement, unless we provide prior written consent.

Subject to the rights granted in this Agreement, you retain ownership of Your Content.

2. Our Rights and Discretion

PPA Tour Canada may, at its sole discretion:

  • review, monitor, edit, crop, format, or remove Your Content;
  • decline to publish or use any submitted content;
  • use only part of Your Content or combine it with other materials; and
  • stop using Your Content at any time.

We are under no obligation to publish, display, credit, or otherwise use any content submitted to us.

3. Prohibited Content

You may not submit content that:

  • infringes or misappropriates any third-party intellectual property, privacy, publicity, or other rights;
  • is subject to an exclusive agreement with another party that prevents you from granting the rights in this Agreement;
  • is false, misleading, defamatory, libelous, or slanderous;
  • is unlawful or promotes illegal activity;
  • contains abusive, harassing, hateful, threatening, or obscene material;
  • depicts dangerous or reckless conduct without appropriate context or permissions;
  • includes individuals (including minors) without necessary consent or authorization; or
  • otherwise violates applicable laws, regulations, or our Platform policies.

4. Representations and Warranties

By submitting Your Content, you represent and warrant that:

  • you are the owner of Your Content, or you have obtained all rights, licenses, permissions, and consents necessary to submit it and grant the rights in this Agreement;
  • Your Content does not violate or infringe any third-party rights, including copyright, trademark, privacy, publicity, or contractual rights;
  • any individuals appearing in Your Content have provided all necessary permissions (and, where applicable, parental/guardian consent);
  • Your Content complies with this Agreement and all applicable laws; and
  • the information you provide in connection with Your Content is accurate and not misleading.

5. Terms of Use

This Agreement is intended to supplement PPA Tour Canada’s Terms of Use and any other applicable Platform policies. In the event of a conflict between this Agreement and the Terms of Use, the Terms of Use will govern unless expressly stated otherwise.

By submitting Your Content, you agree to be bound by this Agreement and the Terms of Use.
